Terms and Conditions

for tattoos and consultations at MF Tattoo Atelier

English translation for your convenience – the German version is legally binding.

§ 1Scope and provider

(1) These General Terms and Conditions (“Terms”) apply to all contracts for tattoos and consultations between you and me:

MF Tattoo Atelier
Marie Friedrich
Poschingerstraße 32A
12157 Berlin, Germany
Phone: +49 1577 6134526
Email: marie@mftattooatelier.com

(2) Anything we agree on individually in a specific case takes precedence over these Terms.

§ 2What I offer

(1) I tattoo Monday through Saturday between 10 a.m. and 6 p.m.

(2) I work by appointment only. I don’t offer walk-ins, meaning tattoos without a previously booked appointment.

(3) I don’t do cover-ups, meaning tattooing over existing tattoos.

(4) Color tattoos are possible with me. I don’t accept elaborate full-color work such as color realism, large saturated areas of color, or color portraits. I decide case by case whether a design fits my work.

(5) I only tattoo people aged 18 or older. Please bring a valid government-issued photo ID to your appointment.

§ 3Inquiry, consultation and booking

(1) I accept booking inquiries through the inquiry form on my website; we arrange everything else by email. I don’t accept bookings via Instagram direct messages.

(2) You can start by booking a free consultation via video call or in the studio. The consultation doesn’t commit you to anything.

(3) Your appointment is only confirmed once I have received a deposit. Until then, your appointment is not reserved, and it’s “first come, first served.”

(4) By paying the deposit, you accept my appointment offer; this concludes the contract. I’ll confirm receipt of the deposit and your appointment by email.

(5) I’ll tell you the amount, payment method and payment deadline of the deposit by email when we arrange your appointment. The deposit is credited toward the price of your tattoo.

§ 4Prices and payment

(1) The starting price is €120.

(2) The price is based on the effort, design, style and duration of the tattoo.

(3) I’ll tell you the price for your design before you book. It depends on effort, design, style and duration; the starting price is €120. You’ll receive the estimated price before the appointment.

(4) All prices are final prices. As a small business under Section 19 of the German VAT Act (UStG), I do not charge VAT.

(5) I’ll tell you when and how to pay the remaining balance by email when we arrange your appointment.

§ 5Cancellation and rescheduling

(1) If you need to cancel or reschedule your appointment, please let me know as early as possible.

(2) Cancellation or rescheduling at least 48 hours before the appointment: The deposit is not kept as a cancellation fee. If you reschedule, it is transferred to the new appointment; if you cancel, it is refunded.

(3) If you cancel or reschedule less than 48 hours before your appointment, the deposit is retained as a cancellation fee. This applies regardless of the reason, including illness. The same applies if you don’t show up for your appointment without canceling.

(4) The cancellation fee is flat-rate compensation for the fact that, at such short notice, I usually can no longer give the slot to someone else. You are expressly entitled to prove that I incurred no loss or a significantly lower loss – for example, because I was still able to rebook the slot. In that case, I’ll only retain the lower amount or refund the deposit.

(5) A new deposit is required for a new appointment.

(6) If I have to cancel an appointment, you’ll get your deposit back in full – or, if you prefer, we’ll transfer it to a new appointment.

(7) Your statutory right of withdrawal (§ 11) remains unaffected.

§ 6Health and preparation

(1) Please tell me before your appointment about anything that may affect tattooing – for example, pregnancy or breastfeeding, blood clotting disorders or blood thinners, allergies, diabetes, epilepsy, cardiovascular or infectious diseases, and skin changes in the area to be tattooed.

(2) Get a good night’s sleep, eat a proper meal 1–2 hours beforehand, and avoid alcohol and drugs.

(3) If I have health concerns, or if you are under the influence of alcohol or drugs, I may refuse or postpone the tattoo. If the reason lies with you and you did not inform me at least 48 hours in advance, § 5 (3) and (4) apply accordingly.

(4) Before we start, I’ll explain the process and the risks to you. Before the session we’ll go over your health together and discuss the risks; please give the necessary information truthfully and completely.

§ 7Design and copyright

(1) Feel free to bring reference images, sketches or a description of your vision; I’ll develop your design from them together with you.

(2) I may not copy other people’s work, such as work by other tattoo artists, without the creator’s consent. References therefore serve as inspiration for an original design. Please only bring material that you are allowed to use for this purpose.

(3) My designs and drawings are protected by copyright; all rights in them remain with me. You are of course free to show, photograph and share your tattoo, including on social media. However, you may not copy or pass on my designs or have them tattooed by others without my consent.

§ 8Photos and videos

(1) I only publish photos or videos of you or your tattoo – for example on Instagram or my website – if you give separate, voluntary consent. This consent is not part of these Terms, and whether you give it has no effect on your appointment.

(2) You can withdraw your consent at any time with effect for the future. You’ll find more details in my privacy policy.

§ 9Healing, touch-ups and defects

(1) After your session, you’ll receive detailed aftercare instructions from me. How a tattoo heals also depends on your skin, the body area and aftercare – every body heals differently.

(2) Touch-ups: I’ll discuss with you before the appointment whether a touch-up is included in the price and until when.

(3) Statutory warranty rights apply. If your tattoo is defective, please first give me the opportunity to correct it, as far as this is reasonable for you.

§ 10Liability

(1) I am liable without limitation for damage resulting from injury to life, body or health, and for damage caused intentionally or through gross negligence.

(2) For other damage caused by slight negligence, I am only liable if I breach an essential contractual obligation – that is, an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In that case, my liability is limited to the foreseeable damage typical for this type of contract.

(3) If you don’t follow the aftercare instructions or give incorrect or incomplete information about your health, this will be taken into account as contributory negligence.

§ 11Right of withdrawal

If our contract is concluded exclusively by means of distance communication – for example via the form on my website, by email or by video call – you have a statutory right of withdrawal as a consumer. The following notice follows the wording of the statutory model.

Withdrawal notice

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (MF Tattoo Atelier, Marie Friedrich, Poschingerstraße 32A, 12157 Berlin, Germany, phone: +49 1577 6134526, email: marie@mftattooatelier.com) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

End of withdrawal notice

If your appointment falls within the withdrawal period, I will only start if you expressly ask me to and confirm that you are aware that your right of withdrawal expires once the contract has been fully performed.
